Terms of Use

These Terms of Use ("Terms") are an agreement between you and Promethium Fantasy LLC, a New Jersey limited liability company ("Promethium," "we," "us"), governing your use of promethiumfantasy.com and the fantasy football game it offers (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Our Privacy Policy is incorporated into these Terms by reference.

The Service

Promethium is a free-to-play, weekly redraft fantasy football game. There is no cost to join a league, no entry fee of any kind, and no cash or other prize of value is awarded for winning or placing in a league, a Showdown, or any other format the Service offers. Nothing about the Service should be understood as gambling or wagering.

We may add, change, or remove features, and may modify or discontinue the Service, at any time.

Eligibility and accounts

• You must be at least 13 years old to use the Service. The Service is not directed to children under 13 — see our Privacy Policy.
• You are responsible for the accuracy of the information you give us, for keeping your password confidential, and for everything that happens under your account. Tell us right away if you believe your account has been compromised.
• One account per person. You may not use another person's account without their permission, or impersonate another person or league member.

Your conduct

Leagues, drafts, chat, and Commissioner's Notes exist for the people in them to enjoy playing together. When using the Service, you agree not to:

• Harass, threaten, or abuse another manager, whether in league chat, notes, or elsewhere in the Service.
• Post content that is unlawful, hateful, obscene, or infringes someone else's rights.
• Attempt to manipulate scoring, drafts, or standings outside how the Service is designed to work, or interfere with another manager's fair use of the Service.
• Attempt to gain unauthorized access to the Service, another account, or our systems, or disrupt the Service's normal operation.
• Use the Service for any purpose that is illegal or not permitted by these Terms.

We may remove content, and may suspend or terminate an account, that violates these Terms.

Leagues and commissioners

A league's commissioner (its owner) can configure that league's scoring rules, roster settings, and membership, and moderate that league's chat and notes. Those choices are between the members of that league; Promethium is not a party to, and is not responsible for resolving, disputes between league members over rules, roster moves, trades, or conduct within a league. We may still act, at our discretion, where conduct violates these Terms.

Statistics and scoring

Player and game statistics displayed in the Service come from a third-party sports data provider. We work to keep stats and scoring accurate and to correct real errors when we find them, but we do not guarantee that any statistic, score, or standing is complete or error-free, and we are not liable for any consequence of a stat correction, scoring delay, or discrepancy with an official NFL record.

Your content

You keep ownership of the content you submit to the Service — your display name, team name, league chat messages, Commissioner's Notes, and any team logo you upload. By submitting it, you grant Promethium a license to store, display, and reproduce it as part of operating the Service, including showing it to other members of your leagues. You represent that you have the right to submit whatever you upload, including any image you use as a team logo.

Advertising

The Service displays advertising, including through Google AdSense, which helps keep Promethium free. We do not control, and are not responsible for, the content of third-party ads, or for any product or service they advertise.

Intellectual property

The Service, including its name, logo, design, and software, is owned by Promethium Fantasy LLC and protected by intellectual property law. These Terms do not grant you any right to use Promethium's name, logo, or branding except as the Service itself allows (for example, sharing a league invite link).

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, Promethium Fantasy LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising out of or related to your use of the Service. Because the Service is free to use, our total liability for any claim relating to the Service is limited to fifty U.S. dollars ($50).

Indemnification

You agree to indemnify and hold Promethium Fantasy LLC harmless from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your use of the Service, your content, or your violation of these Terms.

Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, including for conduct we believe violates these Terms or is harmful to other users or to the Service.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date above, and for significant changes we will provide notice through the Service or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.
